Overview

Gigify builds the technology and infrastructure that enable creative professionals to showcase their talent, build their brands, and connect with event organizers. These Terms of Service (the "Terms") govern your access to and use of the Gigify mobile application, website, and the various booking, payment, and management tools we offer (the "Services"), except where we expressly state that separate terms apply.

These Services are provided to you by Gigify Limited. These Terms constitute a legally binding agreement between you and Gigify Limited. If you do not agree to these Terms, do not access or use the Gigify app or any services covered by these Terms. These Terms make up the entire agreement between you and Gigify Limited regarding your use of our Services and supersede any prior agreements.

Our Role as an Intermediary: Gigify provides a digital marketplace that connects creative professionals ("Talent") with individuals or organizations hosting events ("Clients"). We are an intermediary technology platform; we do not perform creative services ourselves, nor do we employ the Talent on our platform. All Talent operate as independent contractors, responsible for their own service delivery, equipment, and statutory obligations.

How We Facilitate Connections: While we do not charge Clients a subscription fee to browse our marketplace, we facilitate secure transactions through our authorized payment partners. By using our Services, you agree that we may use your personal data to verify your identity and help connect Clients with the most relevant Talent for their specific event needs.

Privacy and Data Usage: We do not sell your personal data to third parties. We only share information between Clients and Talent (such as portfolios or event details) that is strictly necessary to facilitate a booking. Our Privacy Policy explains how we collect and use your personal data to provide our services and ensure platform safety. You can review your privacy choices at any time within your account settings.

1. Who We Are

Gigify is a marketplace that connects creative professionals with clients seeking creative services for events, productions, and projects.

We acts as a platform that facilitates connections between users but does not directly employ or control the creatives offering services


2. Who These Terms Apply To

These Terms apply to everyone who uses the Gigify platform, including:

Clients: individuals or organisations looking to book creative talent for their events (weddings, parties, corporate events, concerts, church programmes, and similar activities).

Talent: creative professionals (DJs, musicians, photographers, videographers, MCs, bands, and others) who offer and deliver services through the platform. Talent operate as independent contractors, not employees of Gigify.


3. Your Account

To use Gigify you must:

  • Be at least 16 years old.
  • Provide accurate, truthful information when registering.
  • Keep your login credentials private. You are responsible for all activity on your account.
  • Notify us immediately at support if you suspect unauthorised access.
  • Talent must also provide a valid government-issued ID before receiving any payouts.

4. Bookings

When a Client selects a Talent and completes payment, a binding booking is created between the Client and the Talent. Gigify facilitates this booking but is not a party to the service contract between Client and Talent.

A booking is only confirmed once the Client's payment has been received and processed by the platform.


5. Payments

Gigify utilizes an authorized third-party payment gateway to facilitate escrow-style settlement. Funds are held pending Gig completion, after which payouts are issued to Talent on a bi-weekly schedule. All payouts are net of the platform commission, the rate of which is specified in the User's account settings and is subject to a 30-day notice period for any modifications.

For Clients, a service fee will be charged at checkout. This fee is shown clearly before you confirm a booking.


6. Cancellations and Refunds

Clients

  • Cancel within 24 hours of booking confirmation: full refund.
  • Cancel more than 5 days before the event: 85% refund (15% administrative fee applies).
  • Cancel 2-5 days before the event: 50% refund
  • Cancel within 48 hours of the event: no refund.
  • For bookings made more than 30 days in advance, a 5-day cancellation window applies from the date of confirmation.

Talents

  • Cancel more than 72 hours before the event: no financial penalty: Client receives a full refund.
  • Cancel 24-72 hours before the event: Talent forfeits 25% of the agreed fee.
  • Cancel within 24 hours of the event: Talent forfeits 50% of the agreed fee.
  • No-show without notice: Talent forfeits 100% of the fee and the account may be suspended.

7. Rules for Everyone

You must not:

  • Arrange payments with the other party outside the platform within 12 months of first contact through Gigify.
  • Provide false information, impersonate anyone, or misrepresent your services.
  • Harass, threaten, or discriminate against any user or Gigify independent contractor.
  • Use the platform for any unlawful purpose.
  • Interfere with the platform's technical systems or attempt to manipulate reviews.

8. User Conduct

Talent: You agree to provide services as described in your portfolio. You must perform services at the agreed date, location, and duration specified in the booking. You must maintain professional standards at all times.

Client: You agree to provide a safe environment for the Talent and pay all fees through the Platform.


9. Content License

Talent grants Gigify a non-exclusive license to use media samples (photos/videos) uploaded to their profile for marketing and platform promotion purposes.


10. Disputes

If something goes wrong with a booking:

  • First, contact the other party directly through the platform's messaging system.
  • If unresolved within 48 hours, raise a dispute with Gigify support. We will review the evidence and respond within 5 business days.
  • For disputes above $20,000 not resolved by Gigify, disputes shall be settled via binding arbitration. The arbitrator's decision is final.

11. Our Liability

Gigify is not responsible for the quality or outcome of services provided by Talent. Our maximum liability to you in connection with any booking is limited to the value of that specific booking.

We are not liable for indirect losses, loss of profit, or losses caused by events outside our control (such as natural disasters, government actions, or internet outages).


12. Your Privacy

We collect and use your personal data (including identity information, contact details, locations, and transaction records) to facilitate bookings, verify identities and prevent fraud in line with global best practices and laws applicable in your jurisdiction.

We use your data to operate the platform, comply with KYC and anti-money laundering obligations, and improve our services. We do not sell your data.

13. Taxes

You are responsible for your own tax obligations. Where required, Gigify will deduct the applicable Withholding Tax from Talent payouts and remit accordingly. Value Added Tax (VAT) applies to platform fees in accordance with the applicable law in your jurisdiction.


14. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or in-app notification at least 30 days before any material change takes effect. Continuing to use the platform after that date means you accept the updated Terms.


15. Closing or Suspending Accounts

We may suspend or permanently close an account if a user breaches these Terms, engages in fraud, or poses a risk to other users or the platform. Where we do so, we will tell you why unless we are legally prevented from doing so.

You may close your account at any time by contactingsupport@thegigify.com. Closing your account does not cancel any pending bookings or outstanding obligations.


16. Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the country where the creative services are performed.

By using the platform, both Talent and Clients submit to the non-exclusive jurisdiction of the courts of the country where the Gig is located, subject to the mandatory dispute resolution process set forth in Clause 10.
